Website terms of use
These terms explain the permitted use of fernley.co, the status of its content and the distinction between a website enquiry and an agreed engagement.
Last updated:
01The website and how to contact us
Fernley is the brand used for this website and the services described on it. We operate from Guangzhou, China. Contact contact@fernley.co with questions about the website or these terms.
These terms relate to use of the website. Any professional engagement requires a separate written agreement identifying the parties, scope, responsibilities and applicable commercial terms. That agreement governs the engagement.
02Website information and professional advice
Website content, including Insights and illustrative frameworks, is provided for general information and discussion. It is not advice tailored to your circumstances and should not be treated as legal, tax, financial, investment or other regulated professional advice. Material decisions should be supported by your own assessment and advice from appropriately qualified professionals where needed.
Sending an enquiry, receiving an acknowledgement or arranging a free consultation does not by itself create a professional engagement, confirm availability or commit either party to a scope of work. No particular commercial or operational outcome is promised by the website.
03Content and intellectual property
Rights in original website content, design and branding belong to their respective owners. Third-party names, materials, quotations and source links retain their own ownership and terms. Citing a source does not imply that its owner endorses Fernley or grants rights beyond those permitted by law.
You may read and link to public pages, and use reasonable extracts for lawful personal or internal business reference with appropriate attribution. Republishing substantial material, adapting the branding, removing notices or using material commercially requires the relevant rights holder’s permission unless the law permits that use. Nothing in these terms restricts a statutory exception or other right that cannot lawfully be restricted.
04Responsible use
Use the website lawfully. Do not attempt unauthorised access, introduce malicious code, interfere with its operation, impersonate another person or submit unlawful, misleading or abusive material. Do not use automated activity to evade security controls or impose a disproportionate load on the service.
Please provide accurate contact details and only submit information that you are authorised to share. An initial enquiry should not contain passwords, identity documents, sensitive personal information or another party’s confidential material. Providing information to us does not transfer ownership of it.
We may take proportionate action to protect the website, including rejecting abusive submissions or limiting access that threatens its security or availability. This does not remove any right or obligation that applies by law.
05Accuracy and availability
We take reasonable care when preparing the website. Information may nevertheless become outdated, contain an error or require qualification in a particular context. Published dates and source references should be considered when assessing material. Please tell us if you identify a material error.
The website may be changed, interrupted or withdrawn for maintenance, security or other operational reasons. We do not promise continuous availability, compatibility with every system or that all content will remain current. Any warranty or duty that cannot lawfully be excluded continues to apply.
06External services and links
External links are provided for reference or to enable a contact channel. We do not control an external website’s content, availability, security or privacy arrangements. Review the relevant provider’s terms before using it. Linking to a service does not, by itself, constitute an endorsement or transfer our own legal responsibilities to that provider.
07Responsibility and mandatory rights
The website is an information resource rather than a substitute for an agreed professional engagement. Subject to the applicable law, we do not accept responsibility for losses that were not reasonably foreseeable from our breach of these website terms, or losses arising solely from use contrary to these terms. Any responsibility for contracted services is addressed in the separate engagement agreement, subject to mandatory law.
Nothing in these terms excludes or limits liability for fraud, intentional wrongdoing, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Your mandatory consumer, personal-information and other statutory rights remain unaffected. A disclaimer does not excuse a breach of those duties.
08Privacy, changes and questions
Our privacy policy describes the information processed through the website and how to contact us about it. Acceptance of these website terms is not consent to marketing or a substitute for any separate data-processing consent required by law.
We may update these terms for future use of the website. The version date is shown above. A website update does not retrospectively change a separate engagement agreement or remove a right that has already arisen. If an applicable mandatory law conflicts with a provision, that law takes priority to the extent of the conflict.
Please raise website questions or concerns with contact@fernley.co so that we can consider them. This contact route does not restrict access to a regulator, court or other remedy available under the applicable law.
